1. Collection and Use of Personal Information

We use personal information supplied by users of The Backyards web app for the purpose of providing our services and improving user experience. The information we collect may include:

• Farm name
• Contact name
• (Partial) phone number
• Country
• Email address

We use this information solely for the purposes mentioned above and do not share or sell this information to third parties for any other reason.

Payment processing is handled independently by Windcave, Inc. We do not track, know or store any financial account details involved with the purchasing process.

Beyond the information supplied by users of The Backyards website and web app, we do not track or record any personally identifiable information from any device used to access these.

2. Cookies and local data

We do not use cookies to store information when signing up, accessing and operating The Backyards web app.

We may use data storage capabilities in your browser for performance and to enable off-line operation.

You can choose to disable data storage in your browser settings, or clear stored items. However, disabling the data storage option or clearing this means the web app may no longer function.

3. Data Security

We take data security seriously and have implemented appropriate measures to protect the personal information we collect. However, please note that no data transmission over the internet or storage method is 100% secure, and we cannot guarantee the absolute security of your data.

4. Data Retention

1. Acceptance of Terms

By applying for membership and accessing or using The Backyards web app, you agree to be bound by these Terms and Conditions.

2. Service Description

The Backyards web app provides members with a platform to store and manage livestock data. Membership providing access to the web app can purchased via our website.

The web app allows animal data to be loaded and this requires an electronic Identification (eID) per animal. Stock Unit credits are consumed per unique eID when first loaded, and per annum thereafter (active animals only). The number of credits used per animal is based on the type of livestock, consistent with the industry standard Livestock Unit (LSU) framework.

A membership includes a starting balance of 500 annual Stock Unit credits. Additional bundles of Stock Unit credits can be purchased via the web app [tap here for current pricing]. A positive balance of credits must be maintained to load animal data.

We reserve the right to terminate your membership for any reason and no refund will be provided.

3. Collection and Transmission of Data

Acceptance of these terms includes your agreement for the The Backyards to collect and securely transmit the information you supply that may be classified as 'Personal and Sensitive User Data'.

This consent can be withdrawn at any time by you, by choosing to cancel your membership via the option provided in the web app, or by notifying The Backyards through the channels provided on the website.

Cancelling your membership will result in the irrecoverable removal of all supplied data, including email address.

4. Member Responsibilities

You are responsible for maintaining the confidentiality of your login information for The Backyards web app and for all activities that occur under your membership account while using this web app. You agree to provide accurate and up-to-date information and to use the web app only for lawful purposes.

When seeking operational support for the web app from us, you agree to our support personnel having access to your membership account including livestock data as required, and that support may be provided by a contracted third-party.

The application fee is non-refundable and in the event you choose to cancel your membership, no refund will be provided for any unused Stock Unit credits.

5. Intellectual Property Rights

All content and materials available on The Backyards web app, including but not limited to text, graphics, logos, button icons, images, audio clips, and software, are the property of our company (The Backyards Ltd) and are protected by applicable intellectual property laws.

6. Limitation of Liability

We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of, or relating to, the use or inability to use our web app. The enabling software is provided on an "as is" basis and may have flaws.

Provision of the service involves various 3rd party service providers including your Internet Service Provider, device manufacturers and retailers, operating system and browser software providers, a global cloud-services provider, a global authentication services provider, global financial payments processing services and your own bank. Members acknowledge that The Backyards Ltd has no control over the delivery, reliability or continuity of these 3rd party services and is not to be held liable in the event such services experience operational failures, and/or downtimes (unavailability) due to system hardware, software maintenance upgrades and updates, or other reasons.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand and those local to your jurisdiction, with New Zealand law taking precedence in the event of conflict or contradiction.

8. Modifications to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Your continued use of the web app after any such changes indicates your acceptance of the modified terms.
